Abstract


A COMPARISON ON TURKISH UNIONISM; WHAT COMES WITH THE CONSTITUTION GOES WITH THE CONSTITUTION
When compared to western countries, the Turkish trade union life started in a relatively late period. In this case, the cultural, social and socio-economic structure of the country played a decisive role as well as the approach of its political will to the subject. The most striking point for the Turkish trade union life is that the rights gained were realized not through the struggle of the working class or social movements but through the decisions of the political will. Trade union rights, which were given by the law and without any pressure elements, have changed with the changing political understanding of almost every period; they were sometimes extended and sometimes restricted. In order to address this situation, including in particular those adopted in 1961 and 1982 issued on the basis of the Constitution of the Republic of Turkey and the laws that regulate the trade union life of Turkey were examined by comparing. As a result of the comparisons, it was seen that organization, collective bargaining and strike rights, which are indispensable for union life, were dealt with a broad and libertarian approach with the 1961 T.R. Constitution, but with the Constitution of 1982, there was a decline in the use of these rights. Although it has been tried to be corrected by the laws, which are relatively new and appropriate to the requirements of the era, it has been concluded that there are serious criticisms and deficiencies regarding trade union freedom and the use of trade union rights.
